These terms apply to every service you buy from MyWebsiteHost. MyWebsiteHost is a trading name of Graeme Preston, a sole trader based in Fiskerton, Southwell, Nottinghamshire, United Kingdom ("we", "us"). You can contact us by opening a support ticket or by email at sales@mywebsitehost.co.uk.
By placing an order you agree to these terms, our Privacy Policy and our Cookie Policy. If you're a consumer, nothing in these terms affects your statutory rights.
1. Your account
- You must give us accurate contact and billing details and keep them up to date. We use them to send invoices, renewal reminders and service notices.
- You're responsible for keeping your client area, hosting panel and email passwords secure, and for anything done using them. Tell us straight away if you think someone else has access.
- You must be 18 or over to open an account.
2. Orders and setup
Most services are set up automatically once payment clears. We may check an order for fraud before setting it up, and we can decline any order. If we do, we'll refund anything you've paid.
3. Payment and renewals
- Services renew automatically at the end of each billing period at the price then shown on our website. We send the renewal invoice 14 days before the due date, and reminders if it stays unpaid.
- If you have a card stored, we'll attempt to take payment shortly before the due date.
- If an invoice is still unpaid 5 days after its due date, the service may be suspended. It is restored automatically when the invoice is paid. A service that stays unpaid may then be terminated and its data deleted.
- Prices are in pounds sterling. We are not VAT-registered, so no VAT is added.
- Usage-based charges (for example extra disk space or accounts on Flexi plans) are measured automatically and added to your next invoice.
4. Cancelling and refunds
You can cancel any service at any time from your client area. It will run until the end of the period you've paid for and won't renew.
Money-back guarantee. If you're a new customer and you're not happy with your Web, WordPress or Reseller hosting, cancel within 30 days of your first payment and we'll refund that payment in full. Some additional services have their own refund period, counted from the date of purchase:
- 30 days: SSL certificates, Professional Email (OX App Suite), CodeGuard, Site Builder and Weebly
- 15 days: NordVPN and SocialBee
- 14 days: 360 Monitoring
To use the guarantee, open a support ticket within the period. It covers the first payment for each service only. It doesn't cover domain registrations, transfers or renewals, or usage-based charges already incurred.
Your statutory right to cancel. If you're a consumer, you also have the right to cancel within 14 days of your order under the Consumer Contracts Regulations 2013. Because our services start straight away at your request, we may deduct a proportionate amount for the time the service has been provided. Domain names are registered for you specifically and can't be cancelled once the registration is complete.
5. Acceptable use
You must not use our services, or let anyone else use them, to:
- host, send or link to anything illegal in the UK, including material that infringes copyright or other intellectual property;
- send unsolicited bulk email (spam), or host websites advertised by spam;
- run phishing, fraud, malware, or anything designed to gain unauthorised access to other systems;
- attack, scan or disrupt other networks or servers;
- use an unfair share of a shared server's resources, for example by running processes that slow the server down for other customers.
If a service breaks these rules, or puts our servers or other customers at risk, we may suspend it without notice while we investigate. We'll tell you why. Serious or repeated breaches may lead to termination without refund.
6. Hosting
- Our hosting runs on servers in a UK data centre in London. We aim to keep it available at all times, but we can't guarantee it will be free of interruption. Planned maintenance and any incidents are posted on our server status page.
- We take daily backups as a safety net, and will restore from them if needed. They are not a substitute for your own backups, and we recommend you keep a copy of anything you can't afford to lose.
- Email is not provided on our hosting servers. Mailboxes are provided through our Professional Email service.
- You're responsible for the content of your websites and for keeping the software you install (such as WordPress, themes and plugins) up to date.
7. Reseller hosting
If you resell our hosting, you're responsible for your own customers, including their support, billing and compliance with section 5. Your customers' use of the service counts as your use. You must not offer your customers terms that conflict with these.
8. Domain names
- Domains are registered with the relevant registry through our registrar partner, and each registry's own rules also apply (for example Nominet's terms for .uk domains).
- You must give accurate registrant details. Registries can suspend domains with false details.
- It's your responsibility to renew your domains on time. We send reminders before expiry, but if a domain expires and isn't renewed it may be lost, and recovering it can cost extra.
9. Third-party services
Some services we sell are provided by other companies, including SSL certificates, Professional Email, SiteLock, CodeGuard, Site Builder, Weebly, marketgoo, SocialBee, 360 Monitoring, NordVPN and email filtering. Their own terms of use may also apply, and we'll pass on any changes they make that affect you.
10. Our liability
- We don't exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be excluded or limited by law.
- If you're a business customer, we're not liable for loss of profits, revenue, data or business, or for indirect losses. Our total liability to you in any 12-month period is limited to the amount you paid us in that period.
- If you're a consumer, we're only responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We're not responsible for losses to your business.
11. Changes to these terms
We may update these terms from time to time, for example when the law or our services change. We'll tell you about significant changes by email at least 30 days before they take effect. If you don't agree, you can cancel before the change applies.
12. Law
These terms are governed by the law of England and Wales, and disputes will be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
